Excessive force is a form of police misconduct. Explain where the line should be drawn when using the amount of force necessary to control a suspect and what some would call brutality. Please use outside resources to answer this question. 3 Paragraphs.

 

Community policing is an approach by which the community and other stakeholders work together with the local police to define community needs and implement crime prevention strategies. This approach has a lot of popularity in many communities and law enforcement circles since its implementation in 1994 (resulting in the adoption of the concept by over 12,000 police departments since that time). Obviously, law enforcement and the communities they serve have spent a lot of time, money and effort on this concept. Has the money, time and effort been well spent? Has the overall result been positive or negative? Why or why not? Provide at least one specific, real-world example that supports your thoughts. 2-3 Paragraphs.

Juvenile and Adult Crime.

Imagine that you are an attorney specializing in juvenile justice cases. You receive a phone call from Mrs. Ingrim, whose 15-year old has been arrested for stealing a car, driving without a license, and finally crashing the car into a storefront. Mrs. Ingrim is distraught and concerned that her child will be held in the county jail and abused. The maximum sentence that can be assessed is 6 years in prison to a minimum of 200 hours of community service and 2 weeks in the county’s boot camp program.
Please answer the following questions. As you answer each question, you must provide support or evidence that will enhance and empirically prove your answers. What are the steps in the juvenile justice process that must be taken to defend Mrs. Ingrim’s teenager? Provide the steps and how you would approach the situation to ensure that every step is handled properly for this case.

Business and Corporation Law.

Swimming pool Co Pty Ltd employs Martin as the manager of their Tasmanian sales division. Martin is to quote to potential customers the cost of installing the various pools that the company offers, to draw up any new contracts on behalf of the company and further to ensure that a deposit is paid by potential customers, monies which are then deposited in the company’s bank account. Martin is on a fixed salary but his contract of employment allows for the payment of a bonus if he exceeds his annual target of signing new customers.

The company is very impressed with Martin in the first month of his employment; he has signed at least 20 new customers and work has begun on at least half of the new projects signed.

After the lapse of another month the company receives a number of complaints from customers who claim that the construction of their swimming pool is substantially different to what they had contracted for. A number of customers were given wrong advice on the suitability of the placement of their new swimming pool, which means some newly constructed pools are sinking into the ground, the repair of which will cost the company considerably. It appears also that some of the deposits have not been paid into the company’s bank. Martin appears to have kept part of the money collected. The company also discovers that Martin is in the process of setting up his own business which will compete with Swimmingpool Co.

In considering the facts above make some legal observations on the following:

  1. Is Swimmingpool Co liable for Martin’s actions? On what basis in law would this be the case?
  2. Can the company claim they are not liable for Martin because he has not followed instructions? Explain.
  3. Is Martin liable to his employer for any of his actions? On what basis in law would he be liable?
  4. Has Martin breached any law if he is planning to set up his business? Explain.

A report has been requested that will show a full list of products offered by the company. Products are divided into categories and each category is further subdivided in subcategories. For example, the category Bikes consists of subcategories such as Mountain Bikes, Touring Bikes, and so forth.The report uses the AdventureWorks sample database.

Exploratory Research Log.

The key to this assignment is examination of the topic from different perspectives, actively seeking opposing or alternate points of view to analyze, compare, contrast, synthesize and evaluate. This is the dialectic process. Remember, you do not need to come to a conclusion or take a stand; in fact, you must avoid taking a firm position. You can and should say if you find one position more logical, easier to believe, or in some way more desirable than another, just don’t declare that position to be the right or best one. Instead, keep your mind open to additional questions, contradictions and complexities that may arise in the course of your research.

Your research log should includes dates and all the necessary reference information for each source, an annotation of the information you found in that source, and your thoughts and reflections, showing how your thinking was influenced by what you learned and what you did next.

These are the requirements:
