Consider all you have learned throughout this course as well as how your culture has shaped your personality development. Reflect: The executive and judicial branches of the U.S. national government often seem to operate independently and with little conflict. Many laws are signed by the President and then implemented without a word from the judicial branch. However, there are times when executive decisions are challenged by the judicial branch in a process called judicial review. In addition, there are times when a judicial review has direct impact on your life. For example, when the Supreme Court declared the Affordable Care Act constitutional, many people without health care insurance were finally able to purchase health care insurance. Additionally, when the Supreme Court declared sections of the Defense of Marriage Act unconstitutional, some of the constraints that prevented many gay and lesbian couples from marrying were eliminated. Executive Order 13658 on February 20, 2014 also had a direct impact on many business people that contract with the federal government by increasing the minimum wage to $10.10 per hour. Clearly, the actions of the executive and judicial branches often directly affect our lives.

The Cooper Processing Company
The Cooper Processing Company (CPC) is a manufacturer/processor of food products. Located in the city of Lansing, Michigan, the company services a national market with processed and packaged meat items such as hot dogs, bologna, sausage, etc. Because the company has been experiencing increased costs in marketing and logistical activities it has hired you as an expert to analyze costs and investments and make recommendations to management. In its most recent fiscal year, the company achieved sales of $100,000,000.
The company sells its products through two separate channels of distribution and each is treated as a profit center with full financial responsibility for income statement and balance sheet. The first channel is to retail grocery stores and supermarkets. The second channel is to foodservice wholesalers who, in turn, sell to restaurants and other foodservice establishments. According to the company accounting records, the retail segment accounts for 60 percent of sales, foodservice for 40 percent. The cost accountant believes that both channels are profitable. He says that the company achieves an overall average gross margin of 60 percent on its sales.
The cost accountant also provides you with the following total costs for various marketing and logistics functions at CPC:
The total of all other expenses at CPC is $15,000,000.
The company’s cost accountant has always allocated all expenses and investments to the channels based on the percentage of sales volume and has used the overall company average of 60 percent gross margin to determine the profitability of each channel of distribution.
You, being much wiser than the company cost accountant, decide to do a little further analysis. The first thing you discover is that, due to differences in product mix sold in each channel, gross margins actually are different in each. You find that the gross margin in the retail channel is 70 percent, in the foodservice channel it is 45 percent.
Next, you find that all of the salespeople are paid a straight salary and all receive exactly the same amount of salary. However, you find that of the 50 sales people employed by CPC, 40 of them are devoted to the retail channel, 10 of them are devoted to the foodservice channel. Since there are no sales managers and each salesperson pays for selling expense out of their salary, this accounts for all of the personal selling expense.
You learn that all sales promotions were conducted in the retail channel.
Next, you discover that there is a great difference in the number of orders placed by customers in each channel and the deliveries to each channel. You find that the retail channel accounts for 70 percent of the orders placed and 80 percent of the delivery expense. The foodservice channel accounts for 30 percent of the orders placed and 20 percent of the delivery expense. Your activity-based approach suggests that this is a reasonable way to trace the costs directly to each segment.
Next you learn that packaging differs for each channel. You discover that retail accounts for 80 percent of the packaging cost, foodservice for 20 percent. (Don’t worry about how you discovered this.)
Next, you discover that only the retail channel requires “labeling.” The company has a machine which applies these labels. The labeling expense of $2,000,000 includes materials, labor, and depreciation of the machine. The machine has an asset value of $10,000,000.
Next, you find that the company has inventory of $10,000,000 (this has also been the average amount of inventory held by the company during the year). You learn that the inventory is specialized by channel. For the retail channel, the inventory is $4,000,000. For the foodservice channel the inventory is $6,000,000. Inventory carrying costs for the firm are 20 percent.
Finally, you learn that the different channels have different terms of sale. Accounts receivable for the retail channel are (and have averaged) $3,000,000. Foodservice accounts receivable are (and have averaged) $1,000,000. You found that the cost of financing accounts receivable is 10 percent.
As hard as you have tried, you cannot find a reasonable basis to trace any other costs or assets directly to the channel segments.

Shandra was a senior in her final semester of the Health Information Management (HIM) program at Anystate University in Smithville. She was completing her final courses, which included Trends in Health Information Management, Organizational Management Theories, and her Professional Practice Experience. Shandra was engaged to Andre, the Assistant Director of Respiratory Therapy at St. James Medical Center, with plans to marry after her graduation. Shandra was carrying a 4.00 grade point average going into her final semester and had hopes of becoming a Health Insurance Portability and Accountability Act (HIPAA) compliance specialist after graduation because she had heard that a new position was being created. She was excited to be able to complete her Professional Practice Experience at St. James Medical Center, the only hospital in Smithville, so she would be able to complete the rest of her courses that same semester, continue to live near her family and fiancé, and hopefully get her foot in the door with a chance at the new HIPAA compliance specialist position.
Shandra started her Professional Practice Experience by attending two full days of orientation with a group of new employees. The orientation sessions included information about infection control, the Occupational Safety and Health Administration, HIPAA, and quality improvement processes. All students and new employees were required to sign confidentiality statements during orientation.
Shandra did exceptionally well completing all of her assigned tasks during her Professional Practice Experience. She also became close with a number of the staff members in the HIM department and in other areas of the facility. She enjoyed being able to take her breaks and lunches with her fiancé and his friends from the hospital.
During breaks and lunches, Shandra overheard a variety of conversations among hospital staff. Occasionally, they would discuss interdepartmental issues, and sometimes they would gossip about hospital staff and physicians. One conversation was focused on a rumor about Henri Pioche, the Director of Respiratory Therapy. Many of the staff members present for the conversation indicated that they heard Mr. Pioche had been diagnosed with some kind of malignant condition and had been recently worked up to determine the possibility of brain metastasis.
Shandra and Andre took their afternoon break alone together that afternoon. Shandra asked Andre if he had heard any kind of confirmation regarding his director’s condition. Andre had only heard rumors, but of course, he was curious because he would be the obvious next in line for the director position.
When Shandra returned to the HIM department after break, she pulled up Henri Pioche’s records and saw that he had recently had a series of outpatient tests at the facility. She researched further and found that the most recent tests indicated brain metastasis that appeared significant. That evening, Shandra shared her findings with Andre.
The following day, Andre decided to approach Henri about the situation. He simply indicated that he had heard of him having serious health issues. Andre volunteered to help in any way possible and stated he was more than willing to cross-train to expand his duties to be able to cover in case Henri had to be gone for an extended period of time or if anything should happen that he might not be able to return, acting as an interim director until a decision could be made about a replacement.

Henri denied his health issues to Andre. He did not want anybody at St. James to know of his condition, at least not this soon. However, it concerned him that Andre seemed too confident about his knowledge of his health status, so he contacted the Director of Health Information Management to investigate who may have had recent access to his health information.
A report was run to provide an audit log for access to Henri’s records, and the HIM department director questioned Shandra to determine why she had been in Henri’s electronic health record. Shandra knew immediately that she could not come up with a verifiable excuse, so she decided that honesty was the best policy in this case and admitted that she had looked to see whether what she heard on break was indeed true.
