In a 10 to- 12 page paper (excluding title and reference pages), discuss the following:

• Brief background of the facility.

Writing the Final Paper

The Final Paper:

PTO policies have become good tools for HR staff to use in terms of organizational incentives.

 

While reviewing the information from the two merged companies, the HR Director has found out that each company has two different PTO policies.

 

Company A has a PTO system in which employees are given 30 days of paid time off each year, which accumulates at the rate of 2.5 days a month. Under this policy, vacation and sick leave are all rolled into one paid leave and any absence whether scheduled, such as vacation, or unscheduled, such as sick leave, are taken from the accumulated leave the employee has earned.

 

Company B has a more traditional leave system in which employees are given 12 days of vacation, 10 days of sick leave and 10 holidays. The company is closed on those holidays. Vacation is accumulated at a day per month. Sick leave has an unlimited accumulation, but unlike vacation would not be paid out upon termination of employment.

 

Since the employees of the merged company will be working side by side, the HR Director has asked you to review the situation and make recommendations for a solution.

 

Instructions:

 

As an HR Director prepare a report addressing the following issues:

 

• Identify any additional information you would need to recommend a solution, and explain where you would likely find that information.
• Discuss any issues you would likely encounter if you were to merge the PTO system to a traditional leave system. Explain which issues would be difficult to solve and why.
• Explain any problems you see with leaving the two systems in place, and identify which system would be assigned for new employees.
• Make a recommendation for one common PTO system. Explain your system and why you think this system is the best system for the company.

You are the manager of Acme Fireworks, a fireworks retailer who sells fireworks, puts on ground display fireworks, and large aerial display fireworks. The company started in the owner’s garage two years ago and now has 15 employees that you manage. The company started as a sole proprietorship, and the owner has never changed the entity. The owner has informed you that the company has received inquiries from several large businesses wondering if the company could create several fireworks displays on a regular basis. The owner told the inquirers that the company could fill such display orders, and a price per display was agreed upon. It was discussed that most of the cost for a fireworks display is for skilled labor, insurance, and the actual service of setting off the fireworks. No other details were discussed. The owner is anticipating that new employees will need to be hired, but he is worried that if the large orders for fireworks displays do not continue, the company will not have the funds to pay the new employees. The owner is now considering changing the business entity, but he does not know what entity to form or how to form it.

The owner has asked you to do the following:

• Determine if the contracts with the businesses will be governed by common law or the Uniform Commercial Code (UCC), and explain why.
• Analyze whether the owner formed a contract with the businesses, and apply the five essential elements of an enforceable contract.
• Explain the potential personal liability to Acme Fireworks if a spectator is injured by a stray firework from a fireworks display.
• Discuss the different employment types and relationships relevant to agency law, and analyze the advantages and disadvantages of each type specific to Acme Fireworks.
• Explain why Acme Fireworks should not operate as a sole proprietorship. Recommend a new business entity, and provide rationale to support your recommendation.

For each task, be sure to analyze the relevant law, apply the facts to the law, and make a conclusion.

As the company prepares to meet demand and capacity requirements for its planned future growth, you have been asked to review the current forecasting strategy and help implement a new strategic plan for forecasting demand. The new forecasting plan ties directly to the overall strategic planning methodology established by the company. The company historically has used a time series method. The forecasting methods under consideration are the following:

Your efforts with MLD Hospital have paid off. The corporation has hired SMP and your staff to provide supply chain management consulting services. Health Maintenance Organizations (HMOs) and prospective payment systems vary widely in quality and costs and employ a variety of methods to control costs. Discuss the financial pros ad cons of HMOs and include a clear discussion of how the HMO impacts quality of health care. Prepare a table which compares and contrasts any TWO existing HMO plans. You may want to select HMO’s from different states to fully explore the differences. Finally, use the information you found to create a strategy for explaining the programs to a patient and their family.
