What advantages and disadvantages do you see for leaders attempting to manage a virtual team consisting of employees around the globe? Explain in detail.

Learning Activity #1

Wilbur, who has had difficulty making up his mind for most of his 29 years, was sitting around on Sunday with some of his friends. At one point, he says, “I’m going to try to sell my car, and if I get an offer close to $9,000 I’m going to take it.” Andy, one of the friends, thinks to himself that this might be a good deal. The following events occur later that same week:

Monday: Wilbur arranges with the local newspaper for an advertisement to run beginning on Saturday which will say, “1999 Honda Prelude, excellent, 1st $8,000 takes it. See it at 1902 Maple Street.”

Thursday: Andy delivers a note to Wilbur, which Wilbur reads later on Tuesday. The note says, “I’ll take your car for $9,000” and what about new tires, and is signed by Andy.

Friday: Wilbur thinks he may have underpriced the car and calls the paper to cancel. It is too late to make changes for Saturday so the ad runs. A new ad will start Sunday that says 1999 Honda Prelude excellent , many options available. $10,000.  Friday night before he goes to bed, he moves the car to the next door neighbor’s driveway and put a sign on the car $10,000.

Saturday: Bob shows up with $8,000 in hand to buy the car. Wilbur refuses to sell the car to Bob.

Andy and Bob each separately sue Wilbur wanting to force him to sell the car claiming that a contract has been formed. Discuss separately each case and how it might come out, including the arguments the parties would most likely raise.  Support your answer with law.

A couple of weeks before he retired, the company director of human resources told Henry that the company would pay for health insurance for Henry and his wife for the remainder of his life, and since he was such a good employee, for his wife’s life if she were to survive him. He then received a letter from the company describing this. Henry had always known that the company provided this benefit to a few of its select employees. Henry didn’t really expect that he would receive it, although he had secretly hoped so for some time. Four years after retirement Henry contracted cancer and incurred substantial medical bills under his insurance plan. Henry then received a letter from his former employer saying that the employer was discontinuing its payment of health insurance for those retirees who were receiving this benefit. You have been selected to be the project manager (for a project of your choice). The project you choose here will be used again in Assignment 4 (Week 6) and you may be asked to reference this project in subsequent weekly discussions. The project that you decide to use should meet the key criteria of a project, such as (a) having a beginning and an end; (b) results in something being delivered to someone; (c) requires a series of activities that must be done to complete the project; and (d) requires resources (e.g, people, materials) to complete the work. Directions:

During the first week of class you conducted your first practice interview.  You have since had the opportunity to learn about the formal process of interviewing and the techniques used in interviewing. With this new information in mind, it is time to develop a detailed plan for your second interview, which you may conduct face-to-face or over the telephone. Your second interview is broken down into two parts.

1. The first portion, preparing for the interview, is due this week in Module 3 (LASA 1).
2.  The second part of this assignment, conducting and analyzing the interview, is due in Module 5 (LASA 2).

For this week you will be completing A. You will need to:

1. 1. Locate a Volunteer:

      He/she will play the role of “client” seeking help for persistent headaches and problems sleeping. The person you interview can be someone you know personally or you can contact your classmates through the Student Lounge to arrange to interview one another.

      1. The client believes that stress may be part of the problem with his/her symptoms.  Remember that this is a role play, and your volunteer should be aware that this is a practice interview and not a real psychological interview.
      2. Prior to conducting your interview, ask your volunteer to think about stress that s/he can discuss related to the client’s problems (e.g., your client may think about stress from a job or stress related to a relationship with a significant other). However, DO NOT have your volunteer discuss this stress with you prior to the interview. You want to be able to explore this topic in depth during your interview. This scenario is intentionally left open-ended in order to allow students to maximize opportunity to utilize interview skills during the interview.
   2. Create an Interview Guide:
      1. In order to achieve a quality interview, you will need to first plan your interview, which is this week’s assignment (you will conduct and analyze the interview in Module 5).
      2. The purpose of your interview is to gather in-depth information to aid in diagnosis and treatment planning for the client.  You will need to gather detailed information about the symptoms being reported for both headaches and sleep problems (e.g., How often are the headaches occurring?  How long do they last?  What do they feel like?  Has any treatment helped?  Is there any pattern to the headaches?).  You will also need to present a complete picture of the patient.  What is the patient’s gender, age, marital status, and employment status?  Be sure to go beyond these example questions, and provide an in-depth, highly detailed interview with your client.

Interview Guide Topics

The Interview Guide should directly address the below topics.  Use each of these topics as headings within your paper to ensure that you directly respond to each.  You should respond with at least a paragraph for each topic/heading.

1. 1. 1. Identify and summarize the purpose of your interview.  How will the information you gather be used?
      2. Explain how you will structure the interview and your reasoning behind the structuring of the interview. Include a list of topics you plan to cover.
      3. Compose the questions you will use to obtain the information (develop a minimum of 15-20 questions). Be sure that you develop a minimum of 5 open and 5 closed ended questions.
      4. Develop a minimum of 5 examples of paraphrasing, summaries, or

         reflections techniques that could be used during your interview (must have at least one of each paraphrase, summary, and reflection). When you conduct your actual interview, these exact examples you create may not fit depending on the responses of your interviewee, but it is important to start thinking now about how you will incorporate these techniques.  For this Interview Guide assignment, develop hypothetical examples of each type of technique.

      5. Identify the opening techniques you will utilize to build rapport with the volunteer/client.
      6. Identify types/examples of questions you want to avoid during interview.

Include an Analysis Summary:

In addition to the Interview Guide include an analysis (2-3 paragraphs) of your own preliminary thoughts about this client based on the limited information you have about this client. Have you ever known a person with chronic headaches or sleep problems? What is your “gut reaction” to hearing about a patient with chronic headaches and problems sleeping? That the person is a complainer? Is he/she a victim of terrible illness? Spend some time examining your thoughts and attitudes. It is normal for all of us to make at least preliminary assumptions about everyone we come in to contact with, and a good interviewer has awareness of his or her preliminary assumptions. Include the following in your analysis:

1. Identify your own beliefs (sympathetic, unsympathetic, or some mixture of both) and explain how these could affect your interview. Do you think that your beliefs are influenced by your own age, cultural, gender, sexual orientation, or ethnicity?
2. Identify steps you can take to limit the impact of your own beliefs on the interview. Be as specific as possible.

In this unit, you have learned many things regarding the Gilded Age while also getting a quick peek into the Progressive Age. Based on this knowledge from the lesson and readings, identify the events introduced in this post-Civil War era that you feel best represent Twain’s imagery of “The Gilded Age.” Explain your reasoning for this selection.

The essay should focus on, but not be limited to, the following:

Identify events surrounding the Native American assimilation efforts, specifically the Dawes Act.

Distinguish how opportunities in mining and trade out west impacted values during the Gilded Age or were impacted by values of the Gilded Age.

Case Study: “El Bulli: The Taste of Innovation”

Instructions: Read the case which can be found on the iTunes U course shell and write a brief case analysis about the organization. A case analysis is NOT a summary, but rather an in depth examination of the concepts described as they relate to the course content.

Students must answer the following:

1) Explain the overall strategy of the entrepreneur and his restaurant as it relates to strategies and concepts discussed in class. You must use at least three (3) examples from class in the answer.

2) Identify the major issues and or problems that the organization faced and provide your own examination rationale and prescription to those problems, i.e. solve them. You must use at least three (3) examples as discussed in class in your answer.

3) What role does innovation play in the case and how does the restaurant’s innovation relate to the course discussions relating to the same topic?

Sudson Washer and Dryer Service is in the business of leasing used washers and dryers to apartment landlords for a contracted lease term. The coin-operated machines are used by apartment tenants. Letisha, 25, a human resource clerk, owns a five-unit apartment complex. While she resides in one of the units, the others are occupied by tenants. Sudson contacts Letisha and offers to lease one washer and one dryer.

The washer and dryer in Letisha’s apartment complex are old and worn-out. Anxious to keep her tenants happy, Letisha meets with Sudson’s salesman who presents her with a one-page agreement for the use of one washer and dryer for five years. The five-year term is standard and the front page of the contract states the lease period. Letisha (as lessee) and the salesman for Sudson (as lessor) sign the front page of the contract and Letisha retains a copy of the signed agreement.

The salesman did not inform Letisha of, nor did she bother to read the back of the agreement which contained additional terms, one of which is an ”automatic renewal” clause that states: “If the lessee fails to provide a 90-day written notice to terminate the contract by certified mail to the lessor, the five-year lease term period shall automatically renew for three additional five-year terms and shall only be subject to termination by the lessor.”

Letisha uses the machines for the five-year period and just a few weeks prior to the end of the term, calls Sudson to provide them with a courtesy notice saying she is not going to renew her agreement. The operator replies that since she failed to provide the 90-day written, certified notice of termination, the lease will be renewed for three five-year terms or another 15 years.

Letisha says that she never saw that clause. The operator replies that it was her obligation to read the back page of the agreement and Sudson will require her to make monthly payments for the next 15 years. Letisha does not know what recourse she now has.

Research whether Letisha has a contract formation or enforcement defense based on the legal and ethical use of automatic renewal clauses in lease agreements, using your textbook, the Argosy University online library resources, and the Internet. Based on the facts of the case and research, write an analytical paper. In the paper, respond to the following questions:

If Letisha does not pay and Sudson sues her for breach of contract, what legal arguments could be raised in Letisha’s defense against the enforcement of the automatic renewal clause? Explain.
What legal arguments could be raised by Sudson in support of the enforcement of the automatic renewal clause against Letisha? Explain.
What ethical issues are raised, if any, by Sudson’s practice of using the automatic renewal clause in their lease agreements? Explain.
Does the Uniform Commercial Code Article 2A apply in this case? Explain.
Are there any government or private entities available to Letisha for lodging complaints about businesses which treat consumers unfairly? Explain.
